REFLEX Marketing Agency provides creative, marketing, content production, social media, advertising, photography, videography, editing, strategy, and related digital services.
Specific deliverables, timelines, pricing, and responsibilities may vary by project and will normally be confirmed through a proposal, quotation, agreement, invoice, or other written communication.
Inquiries and Pricing
Pricing displayed or discussed through the REFLEX platform is not considered final unless confirmed in writing.
Where the website states “Contact us for pricing,” final pricing will depend on factors such as project scope, production requirements, number of shooting days, locations, talent, models, equipment, advertising requirements, website/app requirements, and other services requested.
Submitting an inquiry does not create a binding agreement between the client and REFLEX.
Project Scope
The scope of each project will be based on the services agreed between REFLEX and the client.
Requests outside the agreed scope may require additional fees, additional production time, or a revised quotation.
REFLEX may request written approval before beginning additional work.
Client Responsibilities
Clients are responsible for providing accurate information, timely feedback, necessary approvals, access credentials where required, brand materials, and other resources reasonably needed to complete the project.
Delays caused by missing information, approvals, access, or materials may affect the project schedule.
Payments and Deposits
Payment terms will be confirmed individually for each project.
REFLEX may require a deposit or advance payment before production or services begin.
Unless otherwise agreed in writing, work may be paused if required payments are overdue.
Certain third-party expenses, including models, locations, advertising spend, special equipment, travel, printing, software, or other external costs, may be charged separately.
Scheduling and Production
Shooting dates, production dates, and other scheduled services are subject to availability and confirmation.
Clients should notify REFLEX as early as possible if they need to reschedule a confirmed production.
Additional fees may apply where cancellations or rescheduling result in non-refundable costs, reserved production time, talent fees, location fees, or other expenses.
Revisions
The number of revisions included in a project may be defined in the applicable proposal or agreement.
Additional revisions or substantial changes to an already approved concept may require additional fees.
Creative Direction
REFLEX will use professional creative judgment when producing content, campaigns, photography, video, design, and marketing materials.
References or examples provided by clients are treated as creative direction and inspiration unless an exact requirement is specifically agreed in writing.
Intellectual Property
Ownership and usage rights for final deliverables will depend on the project agreement.
Unless otherwise agreed, REFLEX retains ownership of its internal processes, templates, working files, concepts that are not selected, production methods, and other pre-existing intellectual property.
Rights to third-party assets such as music, fonts, stock media, software, or licensed materials remain subject to the applicable third-party licenses.
Client-Provided Materials
Clients confirm that they have the necessary rights and permissions to use any logos, photos, videos, music, trademarks, text, or other materials they provide to REFLEX.
The client is responsible for claims resulting from materials supplied without appropriate authorization.
Portfolio and Promotional Use
Unless otherwise agreed in writing, REFLEX may display completed public-facing work in its portfolio, website, social media, presentations, case studies, and promotional materials.
Confidential or unreleased projects will not intentionally be published before they are publicly released by the client or otherwise approved.
Social Media and Third-Party Platforms
REFLEX may provide services involving platforms such as Instagram, Facebook, Google, TikTok, or other third-party services.
These platforms operate under their own terms, algorithms, policies, and technical systems, which REFLEX does not control.
REFLEX is not responsible for platform outages, account restrictions, algorithm changes, suspended advertising accounts, policy changes, or similar events outside our control.
Advertising Results
REFLEX may create and manage advertising campaigns with the goal of improving awareness, traffic, engagement, inquiries, conversions, or other agreed objectives.
However, marketing and advertising performance depends on many factors outside REFLEX's control, including market conditions, audience behavior, pricing, competition, client products or services, platform algorithms, budget, and campaign duration.
Therefore, REFLEX does not guarantee specific sales, revenue, follower growth, views, leads, or return on advertising spend unless explicitly agreed in writing.
Website and Application Services
Where REFLEX or its partners provide website or application development services, project functionality and scope will be based on the approved requirements.
Third-party hosting, domains, payment systems, APIs, app stores, software platforms, or integrations may be subject to separate fees and third-party terms.
REFLEX cannot guarantee uninterrupted availability of third-party services.
Limitation of Liability
To the maximum extent permitted by applicable law, REFLEX will not be liable for indirect, incidental, special, consequential, or lost-profit damages resulting from use of our services or third-party platforms.
Nothing in these Terms excludes liability that cannot legally be excluded.
Prohibited Use
Users may not use the REFLEX website, application, or services to:
- engage in illegal activity
- attempt unauthorized access to systems or accounts
- distribute harmful or malicious software
- misuse REFLEX intellectual property
- impersonate another person or business
- submit fraudulent or misleading information
Termination of Services
Either REFLEX or the client may end a project or ongoing service according to the cancellation or termination conditions agreed for that engagement.
Amounts already earned, completed work, non-refundable third-party expenses, or outstanding invoices may remain payable after termination.
Changes to These Terms
REFLEX may update these Terms from time to time.
The latest version will be posted on this page with the updated date.
Continued use of the website or application after an update may constitute acceptance of the revised Terms where permitted by law.
Governing Law
Unless otherwise agreed in writing, these Terms will be governed by the applicable laws of the State of California, United States, without regard to conflict-of-law principles.
